On Thursday, the U.S. Supreme Court appeared to settle the matter, at least in terms of next week’s election.
The justices ruled that Gov. Glenn Youngkin can temporarily purge from Virginia’s voting rolls some 1,600 previously registered Virginia voters who might be noncitizens, while federal courts consider a lawsuit over Youngkin’s action.
Those registered voters were flagged as potential noncitizens because they recently filled out paper or online forms with the Virginia Department of Motor Vehicles, such as to renew a driver’s license or update an address.

"We are pleased by the Supreme Court’s order today," Youngkin told Fox News in a statement following the decision, which he described as a "victory for commonsense and election fairness."

Late Monday, attorneys general from all 26 Republican-led states joined Virginia in filing an amicus brief to the Supreme Court, backing its assertion that the removal program was conducted on an "individualized" basis, and further, that the Justice Department’s reading of the protections granted under NVRA are overly broad and do not apply to noncitizens.
